These terms and conditions apply to the website located at www.takeawaybedding.com and all associated sites (collectively, the “Site”) operated by Takeaway Bedding Marketing. (the “Company”). By accessing any of our websites, email newsletters and subscription, and purchasing in our websites, you are entering into a binding agreement with the Company.
Throughout the site, the terms “we”, “us” and “our” refer to the Company. The Company, “TAKEAWAY BEDDING MARKETING”, offers this website, including all information, tools and services available from this platform, to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
1.1 By submitting your email address in connection with your account, you agree that TAKEAWAY BEDDING MARKETING and its third-party service providers may use your email address to contact you about your TAKEAWAY account or Content you have submitted to the Sites, including the Community, or for other administrative purposes and for any other purpose permitted or required by law.
2.1 You may use the Sites only in the manner permitted by these Terms.
2.2 All intellectual property rights (including copyright, trademarks, patents, design rights, and all other forms of intellectual property rights existing in the world) in the Sites are owned by or licensed to TAKEAWAY BEDDING MARKETING and its affiliates. Nothing in this Term constitutes a transfer of any intellectual property rights.
3.1 To make purchases with TAKEAWAY BEDDING MARKETING, you must be over eighteen (18) years of age. If you are under eighteen (18), you may place an order with TAKEAWAY BEDDING MARKETING only with involvement of a parent or guardian. If you do not have consent from your parent or guardian, you must stop using the Sites.
3.2 To be able to make purchases through our Sites, you will be required to provide us with your personal details. In general, you will be required to provide us with your name, postal address, e-mail address and/or other contact details as indicated.

You shall not commit or encourage any criminal offence, transmit or allocate a virus including but not limited to Trojan horse, worm, logic bomb or post any other material on the Sites which is malicious, technologically harmful, in breach of confidence or in any way offensive or indecent; hack into any aspect of the Service; corrupt data; cause displeasure to other users; infringe upon the rights of any other person’s propriety rights; send any unsolicited advertising or promotional material; or attempt to affect the performance or functionality of any computer facilities of or retrieved throughout the Sites.
EMAIL, FAX AND OTHER FORMS OF ELECTRONIC COMMUNICATION
5.1 You are communicating with us electronically and therefore agree to receiving communications from us electronically when you use our Sites or you send an email to us. TAKEAWAY BEDDING MARKETING will be communicating with you by email or by posting notices on the Sites and/or in our social media platforms. You agree that all agreements, announcements, disclosures and other communication that TAKEAWAY BEDDING MARKETING provides to you electronically fulfil with any legal requirement that such communication be in writing.
5.2 TAKEAWAY BEDDING MARKETING is not responsible for the delivery of any electronic communication. If you have any inquiries regarding on your purchase, please kindly refer to the Contact Us section to submit an online feedback form to us.
6.1 Communications over the Internet and electronic mail may be subject to interruption, blackout or adjourn due to internet traffic, or incorrect data transmission due to the public nature of the Internet. TAKEAWAY BEDDING MARKETING will not be responsible for any non-compliance or adjournment in compliance with any of the duties we assume under a Contract when caused by events that are beyond our ability control (“Force Majeure Events”).
7.1 TAKEAWAY BEDDING MARKETING reserves the right to reject service to anyone for any reason at any time. You perceive that your content (not including credit card information) may be transferred unencrypted and involve transmissions over varied networks and changes to conform and adapt to technical needs of connecting networks or devices. Credit card data is always encrypted throughout transfer over networks. The headings used in this agreement are enclosed for convenience only and will not limit or otherwise affect these Terms.
8.1 TAKEAWAY BEDDING MARKETING may offer various e-vouchers which may apply to any, or certain specified purchases made through our Sites. We are strictly not committed to notify you of any future promotions beyond the present or existing promotion or e-voucher. Every promotion and e-voucher will be subject to specific terms & conditions stated at the time the e-voucher is issued (including and not limited to the duration of the promotion’s or promo code’s validity) in addition to those mentioned in these Terms.
8.2 TAKEAWAY BEDDING MARKETING is not liable to cover the same promotion to those customers who done the purchase steps on our Sites before a promotion is announced in the interest of fairness to our other customers. We have several methods of announcing of our promotions to the public – we may send you the details via email (if you have signed up for our marketing emails, or we may advertise the promotion or promo code on our Website via a banner or pop-up message, or we may announce it on our social media channels, or we may advertise the promotion or promo code in any or all of our official partner showrooms that are listed on our website.
8.3 We have the right to refuse you the use of any promotion or e-voucher once it is expired or fully redeemed. Depending on the promotion or e-voucher, a promo code may only be used once for each customer.
9.1 Products displayed on our Sites only delivers to Malaysia and Singapore only via a third-party delivery service after your order status updated to Order Confirmation.
9.2 For West Malaysia, we will take up to 3 – 5 working days to freshly made your order(s) and deliver your order(s) in the next 3 – 5 working days. For East Malaysia, we will take 7 – 14 working days to deliver your order(s), subject to warehouse stock availability. For Singapore, we will take up to 3 – 5 working days to freshly made your order(s) and delivery take another 5 – 7 working days to reach your hands.
9.3 Delivery time based on our third-party delivery partner’s and cannot be scheduled.
9.4 Nevertheless, you may infrequently experience delays in order delivery for reasons such as a high volume of orders being received during sale periods, public holidays or the occurrence of unforeseen circumstances. As the delivery process are made by a third-party delivery partner, we do not take any responsibility for any late delivery cases during high sales seasons.
9.5 Additional costs might be charged not limited to on-demand delivery or return pick-up requests on a specific time and date will be charged to the customer in case of a return and deducted from the refund amount.
9.6 If you are not able to accept delivery, you may contact with our third-party delivery partner for re-delivery or collection. Please note that in any case, our couriers only deliver on working days (working days might be different in state).
9.7 If delivery or collection is delayed through your unreasonable refusal to accept delivery or if you do not (within 14 working days of our first attempt to deliver your order) accept delivery, we may charge you for any fee and other costs reasonably incurred by us.
PRICE & PAYMENT
10.1 The prices for products available for purchase through the site will be displayed to you on the site.
10.2 Card data will be encrypted if you choose a direct payment gateway to complete your purchase, to minimise the risk of unauthorised access. (Need further elaboration)
11.1 TAKEAWAY BEDDING MARKETING reserves the right without prior notice to withdraw or adjust specifications on products and services offered on this Site without incurring any obligations. TAKEAWAY BEDDING MARKETING cannot promise product availability for all products at all times. Estimated restock dates are not guaranteed or confirmed. Customer purchases and orders are fulfilled on a first come, first served, basis.
12.1 All TAKEAWAY BEDDING MARKETING mattresses are covered by a pro-rated 10-year limited warranty from the day of the delivery to your house. Please refer to our warranty section in order to fully understand the applied conditions.
99 NIGHTS TRIAL PERIOD
13.1 TAKEAWAY BEDDING MARKETING mattress within 99 days of purchase, if for whatever reason you are not completely satisfied with your mattress (excepting wrong size or wrong model ordered), you may contact with us by sending an email to firstname.lastname@example.org and once your eligibility is being confirmed, we’ll arrange our third-party delivery partner to pick up the mattress from your residence.
13.2 For West Malaysia’s customers, your total payment in full for that issue mattress will be fully refunded less the value of any discount, interest accrued, and/or shipping charges. For East Malaysia’s customers, a RM250 will be charge as transportation fee to ship your mattress back to our warehouse. This amount will be directly deduct from the total refund amount. For Singapore’s customers, a RM300 will be charge as transportation fee to ship your mattress back to our warehouse. This amount will be directly deduct from the total refund amount.
13.3 For an eligible, you must be a full-paying customer who directly purchased from our Sites and have been sleeping on your mattress for at least 30 days. It takes 3-4 weeks for your body to adjust to a new mattress, as such, we require you to try the mattress for at least 30 days before making a return request.
13.4 To make a return request, send an email to us with your order number, invoice/receipt and reason for returning to email@example.com.
13.5 You are no longer eligible for a return if being not reachable or do not respond to our attempts to contact you with regards to your return request.
13.6 99 days’ trial is limited to one per household and cannot be used to exchange a mattress for another models and sizes.
13.7 The returned mattress must be in complete sets ( including F.O.C items) and in good condition, even though it will not be resold. Otherwise you will not be granted a return or refund for a damaged or stained mattress.
13.8 Mattress request for return or refund and F.O.C items must be wrapped up compactly using the original plastics or any other plastics that can provide same performance in order to prevent the mattress and F.O.C items from getting dirty or damaged during all the way transport back to our factory. TAKEAWAY BEDDING MARKETING will charge RM300 as a compensation fee (for cleaning and repairs purposes) to those who failing to do this and it will be deducted from your refund amount.
13.9 Pick-up address must be the same as previous delivery address and return is only valid in regions where TAKEAWAY BEDDING MARKETING sells and ships.
14.1 The content on this Sites and Other Services for Online Shopping are provided on an “as is” and “as available” basis. You therefore agree that you use this Website and/or Other Services for Online Shopping and the services provided at your sole risk. TAKEAWAY BEDDING MARKETING, its officers, directors, employees, partners and suppliers disclaim:
14.2 All warranties or representations of any kind regarding this, its operations or the accuracy, reliability, completeness, usefulness, non-infringement of intellectual property rights, or quality of any information, content or material included herein.
14.3 To the fullest extent permitted by applicable laws, all conditions and warranties, express and implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose or non-infringement;
14.4 All liability to you or anyone else for any direct, indirect, special, consequential or punitive loss or damage (including without limitation loss of revenue, loss of goodwill, loss of reputation and loss of, or damage to, data), incurred or suffered in connection with the use or inability to use this Sites whether based in contract, tort or otherwise even if we are informed of their possibility;
14.4 All liability to you or anyone else if interference with or damage to your computer systems occurs in connection with use of this Sites or an external site. You must take your own precautions to ensure that whatever you select for use from this Sites is free of viruses or anything else that may interfere with or damage the operation of your computer systems.
